Can Indian nationals legally buy property in Spain?
Yes, without restriction. Spain places no limitations on property ownership by foreign nationals of any country, including India. You will require a Spanish tax identification number (NIE) to complete the transaction, and your funds will need to be remitted through compliant banking channels. There is no restriction on the quantum of Spanish property an Indian national may own. How does FEMA and the RBI Liberalised Remittance Scheme apply to buying property in Spain?
Under FEMA and RBI guidelines, a resident Indian individual may remit up to USD 250,000 per financial year under the Liberalised Remittance Scheme (LRS) for overseas property acquisition. For properties above this threshold, the purchase is typically structured through NRE or NRO accounts, foreign currency accounts, or through an Indian company with foreign investment approvals in place. The applicable structure depends on the buyer's residency status (NRI or resident Indian) and the source of funds. What are the total acquisition costs for Spanish property beyond the purchase price?
For resale property in Spain, buyers should budget approximately 10 to 13 percent of the purchase price for transaction costs. This covers Transfer Tax (Impuesto de Transmisiones Patrimoniales), notary fees, Land Registry fees, and legal representation. For new developments, VAT at 10 percent applies in lieu of Transfer Tax, with Stamp Duty of approximately 1.5 percent additionally payable. Do we need to be physically present in Spain to complete the purchase?
